Thank you for using MoreTickets! This User Agreement ("this Agreement") contain the rules that govern your use of MoreTickets applications, websites, products and services (collectively as "Services"). This Agreement forms a binding agreement between you and us. agreement between you and us. By completing the registration process and/or browsing the Services, you represent that (1) you have read, understand and agree to be bound by this Agreement; (2) you are legal age to form a biding contract with us; (3) you have the authority to enter into this Agreement personally. You should not access or use the Services unless you agree to be bound by all of this Agreement.
1. Definition
1.1 MoreTickets: Refers to the website www.moretickets.com and mobile apps, which is a platform to connect sellers and buyers to seller and/or buy tickets, primarily providing technical support and related services for you.
1.2 MoreTickets Service Provider (“we” or “us”): means MORE TICKETS PTE. LIMITED, with its registered office at 3 Philip Street, #09-02, Royal Group Building, Singapore 048693, and its affiliated companies, being the operator and website technology service provider of MoreTickets.
1.3 MoreTickets Parties: we, our parents, subsidiaries, affiliates, directors, employees, licensors and partners, collectively as the “MoreTickets Parties”.
1.4 User: including visitors to MoreTickets and those who use MoreTickets to buy Tickets or engages in any transactions on MoreTickets as “you”.。
1.5 Buyer: means the User who buys Ticket(s) via MoreTickets.
1.6 Seller: means the legal entity that acts as the seller of Tickets transaction, being the legal owner of Tickets.
1.7 Ticket(s): means various types of activity tickets or similar related tickets for performances, sports events, exhibitions, etc., offered for sale by a Seller on MoreTickets.
1.8 Event: means the performance, sports, exhibitions or such other event to which a Ticket relates.
1.9 Event Organizer: means the organizer of an Event.
1.10 Ticket Price: means the selling price set by the Seller for tickets.
1.11 Personal Information: means any information that relates to you, that can be used (directly or indirectly) to identify you, which we will process in connection with your use of MoreTickets.
2. Overview
2.1 This Agreement are between you and MORE TICKETS PTE. LIMITED.
2.2 Your use of, and participation in, certain Services are also subject to additional service policies、rules or terms of we may publish from time to time (“Policies”). IF THIS AGREEMENT IS INCONSISTENT WITH THE SPECIFIC POLICIES ON THE RELEVANT SUBJECT MATTER, THE SPECIFIC POLICIES SHALL PREVAIL.
2.3 This Agreement and the Specific Policies are subject to change by us in our discretion at any time. When changes are made, we will publish the current Agreement on MoreTickets, and we will also update the “Last Updated” date at the top of this Agreement. Unless otherwise stated in such update, any changes to this Agreement will be effective immediately for Users without an Account and seven (7) days after posting for Users with Accounts. If you do not agree to any change(s) after receiving notice of such change(s), you shall stop using the Services. Otherwise, your continued use of the Services constitutes your acceptance of such change(s). Please check the application or website regularly to check the then-current Agreement and Specific Policies.
3. Services Rules
3.1 WE ARE NEITHER SELLER NOR BUYER ON MORETICKETS NOR THE AGENT OF ANY OF THEM, AND DOES NOT OFFER ANY TICKETS FOR SALE, PURCHASE, RENTING OR TRANSFERRING. We only offer the Services that allows Users to offer, sell and buy tickets, and to manage and facilitate transactions made via MoreTickets. THE ACTUAL CONTRACT FOR ANY SALE AND PURCHASE IS DIRECTLY MADE BETWEEN THE SELLER AND THE BUYER. We are not liable to any person in relation to any offer, sale or purchase of any Ticket listed on MoreTickets and is not responsible or liable for the enforcement of any contractual obligations between you and any Seller.
3.2 WE HAVE NO CONTROL WHATSOEVER OVER, AND DOES NOT GUARANTEE: (a) THE EXISTENCE, QUALITY, VALIDITY OR LEGALITY OF ANY TICKET OFFERED, LISTED OR ADVERTISED ON MORETICKETS; (b) THE ACCURACY, COMPLETENESS OR RELIABILITY OF ANY CONTENT OR LISTINGS POSTED BY ANY USER; (c)the credit worthiness of any User; (d) the ability of any User to sell or buy, or that a particular buyer and Seller will complete a particular transaction. Under no circumstances shall we be liable to you for any loss whatsoever arising out of or in connection with any transaction conducted on Moretickets or through the Services, unless such losses resulted directly from our fraud or willful default.
3.3 You are responsible for all Content you contribute, in any manner, to the Services, and you warrant you have all rights to contribute such Content to the Services.
3.4 Your interactions with other users, other entities or individuals as a result of your use of the Services, including communications, payments, performances and deliveries, are solely between you and such third parties; provided, however, that we reserve the right, but has no obligation, to intercede in such interactions. You should make whatever investigation and/or seek whatever professional advice as you feel necessary or appropriate before proceeding with any interaction with any of these third parties. You acknowledge and agree that we are not responsible for any loss or damage incurred as the result of such interactions. You agree that we will not be responsible for any liability incurred as the result of such interactions.
4. User Registration
4.1 Create an account: Before using our services, you must first create an account on MoreTickets ("Account").
4.2 Age restriction: You must be at least 18 years old and of legal age to enter into a binding contract. Juveniles under the age of 18 and over the age of 13 may only use our Services through an account owned by their legal guardian with their permission and under their direct supervision. Children under the age of 13 may not use the Service.
4.3 Use restriction: You may not use the Services if: (a) you are unable to enter into a binding contract with us; (b) you are located in a country embargoed by your country of residence or other relevant country; (c) you are located in any organization's list of prohibited persons or entities, such as the United Nations Security Council sanctions list; (d) we, in our sole discretion, prohibit you from using the Services.
4.4 Registration information: You agree to provide the Personal Information as prompted by MoreTickets registration procedure, including but not limited to your valid email address.
4.5 Accuracy: All the information provided by you shall be accurate, complete and not misleading. You must ensure that all information provided by you is true, current, accurate and complete. You must also promptly update your information when there is any change, in order to ensure the authenticity, timeliness, completeness, and accuracy of the information provided by you to MoreTickets.
4.6 Account security: You shall be solely responsible for ensuring and maintaining the confidentiality of your user identification. You are solely responsible for any activity relating to your user account. Your user account is not transferable to another party under any circumstances.
4.7 Suspend Account: We reserve the right to temporarily or permanently suspend your user account if you fail to comply with any terms or conditions of this Agreement.
4.8 Identification: In order to check and verify any data in our system and public databases for the purpose of detecting any suspicious behavior, we may require you to provide any additional identification documentation. These documentation must be original copies of your identity document(s), which must not be altered or tampered in any manner.
5. Privacy
5.1 MoreTickets Privacy Policy provides information about how we collect, use, and disclose your personal information when you access, visit or use the Services. In connection with your use of the Services, you acknowledge and agree that we may collect, access, use, preserve and disclose your personal information (including your Account and user information) as described in MoreTickets Privacy Policy. The MoreTickets Privacy Policy is part of and is governed by this Agreement and by agreeing to this Agreement, you agree to be bound by the terms of the MoreTickets Privacy Policy.
6. Use Rules and Restrictions
6.1 You agree and undertake to use the Services in accordance with all applicable laws and all various Policies and notices that have been or will be issued by MoreTickets from time to time.
6.2 You must not use the Services for any purpose that harms, affects, or infringes upon the rights and interests of other Users or third parties, and you must not perform any acts which may cause any damage, stress, overload, disruption, interference or obstruction to the website services, website equipment and data files, or any content stored in any computer system (hardware and software) of MoreTickets and/or any other network users.
6.3 When using the Services, you agree and undertake that you will not do any of the following:
(1) violate any of this Agreement, the Policies, or applicable laws and regulations;
(2) circumvent or attempt to circumvent any of this Agreement, the Policies or other rules relating to the Services;
(3) infringe or violate another person's rights including intellectual property rights;
(4) behave in an abusive manner to any of our employees or other Users or Sellers;
(5) violate any venue or Event Organizer rules at Events or violate any applicable third party terms of service;
(6) post, disseminate or publish any false, inaccurate, misleading, defamatory or libelous content or information;
(7) conceal your true IP address, or otherwise impersonate or misrepresent your identity or your affiliation with any person or entity;
(8) interfere or disrupt or attempt to interfere and disrupt with the proper working and operation of MoreTickets or the Services or any other activities conducted on or with us or the Services;
(9) use any robot, spider, scraper or other automated means to access MoreTickets or the Services for any purpose without our express prior written consent;
(10) decompile, reverse engineer, or otherwise obtain the source code or underlying ideas or information of or relating to the Services;
(11) commercialize any of our applications or any information or software associated with such application;
(12) do anything that we determine, in its sole absolute discretion, to be misuses of MoreTickets or the Services or otherwise to constitute any negative impact on us.
If we become aware of any possible violations by you of this Agreement or other Policies, we reserve the right to investigate such violations. If, as a result of the investigation, we believe that criminal activity has occurred, we reserve the right to refer the matter to, and to cooperate with, any and all applicable legal authorities.
6.4 The content of MoreTickets includes text content, photos, graphics, images, icons, technology, software, links and other audiovisual or audio contents, graphic design and source code (collectively the "Content"). You agree and undertake to use the Content in accordance with all applicable laws and regulations, any terms of use and other Policies promulgated by MoreTickets from time to time, and agree and undertake to avoid:
(a) Reproduction, dissemination, provision or disclosure by any means, or alteration or modification of the Content;
(b) Deleting, falsifying or altering by any means any MoreTickets Properties, or any identification information, digital fingerprints, or any electronic identification means relating to any MoreTickets Properties.
6.5 You shall not use or procure to use any means or procedures to obtain the Content for any commercial purposes other than those specifically permitted by this Agreement or us.
7. Purchases
7.1 As the Buyer, You agree to pay all prices related to the ticket purchase according to the final order amount generated, these prices are valid during the order "pending payment" period. Once you complete the payment, you shall be deemed to have agreed to the ticket price quoted by the Seller ("Ticket Price", which may be subject to change at any time before the completion of the transaction), and we are entitled to charge a certain fee for the Services ("Services Fee"). Service Fee may vary depending on event type, Ticket Type. We may in our sole and absolute discretion change our Service Fee at any time. Any applicable Service Fee will be disclosed to you prior to buying a Ticket. We may change and/or retain Service Fee if you do not fulfill your contractual obligations under this Agreement.
7.2 You, the Buyer, are responsible for confirming the full order listing before purchasing any tickets. The prices shown on the order listing include: (i) The "Ticket Price" quoted and set by Seller; (ii)MoreTickets "Services Fee"; (iii)shipping costs. All prices shown on the order listing may do not include payment gateway fees, customs duties, sales taxes, or other amounts that may be associated with your purchase, which will be charged to you separately.
7.3 When you place an order fulfilled outside the Seller's place of delivery, the title to the purchased ticket and risk of damage or loss pass to you upon delivery of the ticket to the first international carrier outside the Seller's place of delivery. In addition, you agree that, where applicable and unless otherwise specified, you may act as the importer of record for certain tickets purchased and you hereby authorize us to appoint a freight forwarder/customs broker to act as your direct representative and pay any sales tax and customs duties on your behalf. Note that customs duties may be imposed on tickets that you purchase if the total value of imported tickets exceeds the threshold amount as specified by applicable laws. Note that tax and similar charges and fees collected at the time of purchase are estimates and may be subject to change in accordance with applicable laws. If additional amounts are assessed, you are obligated to pay them. We will not be responsible for delays in ticket delivery or denial of customs clearance due to your failure to pay such charges and fees.
7.4 If you purchase any ticket which is an electronic Ticket (“E-ticket”), the E-Ticket will be delivered to the email address provided by you, the title to the purchased E-ticket and risk of damage or loss pass to you upon the E-ticket arrives at your email address.
7.5 You understand and agree that ALL DESCRIPTIONS OF TICKET-RELATED INFORMATION (INCLUDING BUT NOT LIMITED TO TICKET PRICE, SEAT INFORMATION, TICKET RESTRICTIONS, ETC.) ON MORETICKETS ARE MADE BY THE SELLER, while we have asked the Seller to guarantee the accuracy of the ticket information, inaccuracies or omissions of ticket information descriptions may occur. We reserve the right to correct any errors, inaccuracies or omissions and to cancel orders or parts of orders if any information on MoreTickets is inaccurate at any time without prior notice.
NOTE THAT THE TICKET PRICE ON MORETICKETS MAY BE DIFFERENT FROM THE TICKET ORIGINAL PRICE (FACE VALUE), YOU SHOULD DO YOUR OWN CONFIRMATION BEFORE MAKING A PURCHASE IF THE TICKET ORIGINAL PRICE IS IMPORTANT TO YOUR PURCHASE.
7.6 You acknowledge that the tickets are in conformity with the transaction or purchase expectations if they: (i) comply with the description provided on oder; or (ii) a better Ticket (e.g. a ticket which face value is not less than the face value of the ticket that you ordered and paid); or (iii) comply with the transaction content which you have negotiated changes with the Seller on MoreTickets.
7.7 If you wish to purchase any ticket on MoreTickets, you must provide the Seller and MoreTickets with appropriate and accurate information necessary for delivery of tickets to you, including but not limited to, your valid email address and physical address. Delivery of any ticket is entirely at your own risk. If any ticket delivery to you fails as a result of any inaccurate information provided by you, or you being unavailable to collect the Tickets when they are delivered to such delivery address provided by you, we shall not be liable to you for any loss whatsoever arising out of or in connection with such delivery failure, and you will not be eligible for any refund.
In any circumstances, if you fail to comply with any provisions of this Agreement (including this clause) thereby resulting in MoreTickets incurring any additional expenses for engaging any third- party delivery company or arranging for redelivery of the ticket, you shall be solely liable and shall pay to MoreTickets all such expenses incurred.
7.8 All payments payable by you shall be due and payable immediately. You shall use any payment method acceptable to us to pay for the purchase of tickets. YOU AUTHORIZE US AND OUR AFFILIATES COMPANY OR PAYMENT SERVICE PROCESSORS TO CHARGE THE FOLLOWING FEES THROUGH THE PAYMENT METHOD:(A) THE AMOUNT PAYABLE FOR PURCHASING TICKETS (INCLUDING TICKET PRICE, SERVICE FEE, AND OTHER RELATED CHARGES); (B) ALL APPLICABLE TAXES AND SHIPPING COSTS; (C) ANY OTHER FEES RELATED TO YOUR USE OF THE SERVICES (INCLUDING, BUT NOT LIMITED TO, PAYMENT GATEWAY FEES). We reserve the right to refuse, freeze, or withhold your transaction for any reason, especially if we suspect fraud, money laundering, or violations of sanctions requirements, or if we believe the transaction may pose a risk to us or any third party.
7.9 The Ticket Price you pay will be collected by us or our affiliates in advance, and the Ticket Price will still be collected by the Seller in the end. You should take note that all your purchase orders shall be final. You cannot change or cancel any purchase order once the transaction is confirmed.
7.10 Your payment obligation is satisfied when we have duly received from you the relevant payment in full.
8. Return and Refund；Additional Compensation
8.1 All tickets sold are NON-REFUNDABLE and NON-EXCHANGEABLE, the ticket has been sold when you successfully pay for the purchase order.
8.2 For all the tickets purchased on MoreTickets, if you do not obtain a ticket that matches your order requirements, you may be entitled to a return and refund. For details of return and refund, please visit Appendix Return and Refund Policy at the end of this Agreement. You acknowledge and agree that we may refund you in accordance with the Return and Refund Policy. The refund will not cover payment gateway fees, customs, taxes, or shipping costs which may incur in the refund process, unless otherwise described in the Return and Refund Policy.
8.3 You can inquire about ticket returns, refunds, and other matters related to your ticket purchase through our customer service.
9. Event Cancellations, Postponement and Other Event Changes
9.1 If an event is canceled or postponed, we will inform you about the cancellation or postponement with further instructions, and refund you according to the Appendix Return and Refund Policy at the end of this Agreement (including Ticket Price and Service Fee you paid) unless we inform you that you can choose to retain the tickets until the event restarts.
NOTE THAT IF THE SELLER REQUIRES THE SELLER’S TICKET(S) BACK, YOU ARE REQUIRED TO RETAIN THE TICKET(S) AND UPON OUR REQUEST TO SEND THEM BACK TO EITHER THE SELLER OR TO US (AS INSTRUCTED BY US). IF THE SELLER OR WE FAIL TO RECEIVE YOUR RETURNED TICKETS WITHIN THE TIME SPECIFIED IN THE INSTRUCTIONS, YOU WILL NOT RECEIVE ANY REFUND.
9.2 We are not responsible or liable to you for any losses or damages whatsoever due to any changes to an event, such as partial performances, venue, line-up or time changes. Under no circumstances shall you be entitled to any refunds under such circumstances.
10. Notice
10.1 You consent to receive communications from us electronically, such as emails, MoreTickets in-app messages, mobile push notices and messages on or through the Services (collectively as "Messages") . You acknowledge and agree that all agreements, terms, notices, disclosures, and other communications and documents that we provide to you electronically constitute and shall have the same legal effect as "in writing".
NOTE THAT MORETICKETS IN-APP MESSAGES AND MOBILE PUSH NOTICES ARE VALID COMMUNICATION METHODS. THE CONTENT OF SUCH MESSAGES IS LIKELY TO HAVE A SIGNIFICANT BENEFICIAL OR ADVERSE IMPACT ON YOUR RIGHTS AND OBLIGATIONS. PLEASE BE SURE TO PAY ATTENTION IN A TIMELY MANNER.
10.2 Under special circumstances, in order to contact you promptly, we may also contact you via other contact information provided by you to us (such as mobile phone calls, mobile phone messages, etc.).
10.3 All Messages sent by us to you using your provided contact information will be considered valid and deemed to have been duly received by you. For this reason, you must make sure that all information provided by you is accurate and up-to-date, and inform us promptly whenever your contact information has changed.
11. Delivery
11.1 When the Seller is unable to deliver the ticket to you and chooses to engage us for ticket delivery services, we will assist the Seller in providing you with reliable and secure ticket delivery services.
NOTE THAT THE SELLER CAN NOTIFY YOU 7 DAYS BEFORE THE EVENT DATE TO CHANGE THE DELIVERY METHOD FROM EXPRESS TO "MEETUP ON THE EVENT DAY".
11.2 Express services will be provided by a third party professional express company and tracking number information will be displayed on the order details page.
11.3 You must fill in your correct delivery address to ensure that the Ticket can be received by you. In any case, all fees for our delivery services shall be borne by you and shall be non-refundable in any event. In no circumstances shall MoreTickets accept any responsibility or liability for delivery failure as a result of any inaccurate information provided by you.
12. Force Majeure
12.1 For the purposes of this Agreement, ‘Force Majeure’ means any cause beyond our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to you for failure to perform any obligation under this Agreement to the extent that the failure is caused by Force Majeure.
13. Intellectual Property
13.1 The MoreTickets Properties, including all trademarks, trade names, logos and/or intellectual property of any form appearing on MoreTickets, are the property of us. You do not have, and have not been granted, any right, interest or title whatsoever in or to any of the MoreTickets Properties, and your use of or access to MoreTickets and/or the Services does not imply otherwise.
14. Responsibilities; Third Party Risks
14.1 YOU ACKNOWLEDGE AND AGREE THAT ANY CONTENT PUBLICLY POSTED OR PRIVATELY TRANSMITTED THROUGH THE SERVICES IS THE SOLE RESPONSIBILITY OF THE PERSON THAT POSTED OR TRANSMITTED SUCH CONTENT. YOU ACCESS AND USE THE CONTENT AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY ERRORS, MISTAKES, OMISSIONS, INACCURACIES IN THE CONTENT. WE DO NOT CONTROL THE CONTENT AND HAVE NO DUTY TO TAKE ANY ACTION REGARDING HOW YOU MAY INTERPRET, USE OR REACT TO THE CONTENT. WE HAVE NO OBLIGATION TO REVIEW OR MONITOR, AND DO NOT APPROVE, ENDORSE, OR MAKE ANY REPRESENTATIONS OR WARRANTIES WITH RESPECT TO CONTENT.
14.2 You are responsible for the Content provided to us and/or the Services in any manner, and you warrant that you have all rights to provide such Content to us and/or the Services in such manner.
14.3 The Service may contain links to third-party websites or services that are not owned or controlled by us. YOU ACKNOWLEDGE AND AGREE THAT WE ARE NOT RESPONSIBLE FOR ANY RISKS ARISING FROM YOUR USE OF ANY THIRD-PARTY WEBSITE OR SERVICE.
14.4 ANY INTERACTION BETWEEN YOU AND THE SELLER, OTHER ENTITIES OR INDIVIDUALS AS A RESULT OF YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO COMMUNICATIONS, PAYMENTS, DELIVERIES, IS SOLELY BETWEEN YOU AND THAT PARTICULAR THIRD PARTY. YOU ACKNOWLEDGE AND AGREE THAT WE ARE NOT RESPONSIBLE FOR SUCH INTERACTIONS AND WILL NOT BE LIABLE FOR ANY LIABILITY ARISING FROM SUCH INTERACTIONS. HOWEVER, WE RESERVE THE RIGHT TO INTERVENE IN SUCH INTERACTIONS TO MEDIATE, AND SUCH MEDIATION DOES NOT CONSTITUTE ANY LIMITATION OF YOUR LEGITIMATE RIGHTS.
14.5 Your interactions with Sellers, other entities or individuals outside MoreTickets, including but not limited to communications, payments, fulfillment and delivery, are not our responsibility.
15. WARRANTY DISCLAIMER
15.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW WE EXPRESSLY DISCLAIM ALL REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, RELATING TO THE SERVICES, ANY CONTENT OR ANY TICKET PURCHASED ON OR THROUGH THE SERVICES, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF THE CONTENT'S ACCURACY, CORRECTNESS, COMPLETENESS, OR LEGALITY. ALL SUCH WARRANTIES, REPRESENTATIONS AND UNDERTAKINGS ARE HEREBY EXPRESSLY EXCLUDED. NO COMMUNICATION OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. THIS SECTION 15.1 DOES NOT AFFECT MORETICKETS RETURN AND REFUND POLICY.
15.2 YOU ACKNOWLEDGE AND AGREE THAT MORETICKETS PARTIES SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES OR LOSS WHATSOEVER AS A RESULT OF OR IN CONNECTION WITH THE CONDUCT OF ANY THIRD PARTIES, INCLUDING BUT NOT LIMITED TO SELLERS, OPERATORS OF EXTERNAL SITES.
15.3 We do not guarantee the Content will be free of virus or any other malware that may lead to changes and/or disruptions to your computer system (software and hardware) or other electronic files stored on your computer, and we shall not be liable to you for any damages or loss whatsoever as a result thereof or in connection therewith.
15.4 We do not guarantee or assume any liability or responsibility to ensure or maintain the continued availability of MoreTickets and/or the Services. We will endeavor to inform the users of any possible interruptions of MoreTickets and/or the Services so far as it is reasonably practicable.
15.5 To the extent permitted by laws, we shall not be liable to you for any damages or loss whatsoever due to any continuity problem of MoreTickets and/or the Services.
15.6 You acknowledge and agree that we shall be under no duty to and cannot control the use of the Services and Content by any User. We do not guarantee that Users will use MoreTickets in accordance with this Agreement.
16. LIMITATION OF LIABILITY
16.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MORETICKETS PARTIES SHALL NOT BE LIABLE TO YOU UNDER ANY CIRCUMSTANCES FOR (A) ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES; (B) LOSS OF PROFITS, GOODWILL OR REPUTATION, OR OTHER INTANGIBLE LOSSES.
16.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCE WILL THE TOTAL AGGREGATE AMOUNT FOR WHICH THE MORETICKETS PARTIES ARE LIABLE TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT OF FEES IN DISPUTE WHICH YOU PAID TO MORETICKETS IN THE 1 MONTH PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR (B) $100 (OR HK$100, AS APPLICABLE), OR (C) THE REMEDY OR PENALTY IMPOSED BY THE STATUTE UNDER WHICH SUCH CLAIM ARISES. THE PRECEDING SENTENCE SHALL NOT PRECLUDE THE REQUIREMENT FOR YOU TO PROVE ACTUAL DAMAGES.
16.3 Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, if these laws apply to you, such disclaimers and exclusions may not apply to you and you may have additional rights.
17. Indemnity
17.1 You shall indemnify and hold us harmless, on demand and without limitation, from and against any and all actions, claims, demands, suits, proceedings, losses, liabilities, damages, interest, penalties, costs (including legal costs on a solicitor-client basis), charges, expenses, or other liabilities that we may reasonably incur or suffer as a result of or in connection with (i) your improper use of the Services and/or the Content, or (ii) any inaccuracies, invalidity, incompleteness, or lack of authenticity in the Personal Information, including, but not limited to, impersonation of others or the unauthorized use or embezzlement of data.
17.2 You agree that the provisions of this section will survive the termination of your account, this Agreement, and/or your access to the Service.
18. Termination
18.1 You shall indemnify MoreTickets Parties, by payment on demand to you, from and against all or any actions, claims, demands, suits, proceedings, losses, liabilities, damages, interest, penalties, costs (including all legal costs on a solicitor and own client basis), charges, expenses or other liabilities which MoreTickets Parties may reasonably incur or be suffered as a result of or in connection with your actions and omissions or violations or breach of the provisions of this Agreement. Without prejudice to the foregoing, we expressly reserves the right to immediately terminate this Agreement without prior notice to you.
19. Applicable Law and Jurisdiction
19.1 The construction, validity and performance of this Agreement and the Policies shall be governed by the laws of Singapore. Any dispute or claim relating in any way to this Agreement or your use of MoreTickets will be resolved by arbitration conducted by Singapore International Arbitration Centre.
20. Miscellaneous
20.1 We may update the terms of this Agreement from time to time. When we update this Agreement, we will notify you by updating the "Last Updated" date at the beginning of this Agreement and posting the updated Agreement on MoreTickets or providing any other notice to you as permitted by applicable laws. Your continued access to or use of MoreTickets after the date of the updated Agreement constitutes your acceptance of the updated Agreement.
20.2 We will investigate all rewards, refunds, additional compensation, claims on MoreTickets and determine resolutions on a case-by-case basis. Such decisions are final. We reserve the right to limit the amount a Buyer or Seller may be awarded and the number of rewards, refunds, additional compensation, claims a Buyer or Seller may file in a calendar year. We may temporarily or permanently suspend any Buyer or Seller who attempts to abuse the MoreTickets Policies and may report any such abuse to the appropriate legal authorities.
